The decision on the invalidation of the regulation concerning registration in the republican law on the free provision of land lots has been made in the Supreme Court of the Republic of Buryatia on April 14. 

If the court decision comes into force about a thousand people who built their houses in the period up to the 31st of December 2010 will be able to authorize in accordance with the law, without a certificate of registration at place of residence in a residential house.

It is to be recalled that at the present time one of the problems of implementation of the law concerning free provision of land lots by right of ownership is the presence in its  current edition the demand for provision by citizens the certificate of residence registration as a document confirming the actual use of the land lot.

The Head of Buryatia Vyacheslav Nagovitsyn in November 2015 has introduced the bill to the People’s Khural, according to which one of the documents confirming the actual use of the land lot could be presented. This condition could help to exclude from the number of mandatory documents presentation of a certificate of registration at the place of residence. However, in the proposed edition the project of the republican law was not adopted by the People’s Khural of the Republic of Buryatia.

On behalf of the Head of the Republic the Ministry of Property Relations of the Republic of Buryatia jointly with the City administration have continued to defend the interests of citizens. “Since the current legislation does not allow to register in illegally constructed houses, many self-willed builders do not have registration at the place of residence and, therefore, they can not exercise the right for legalization  their houses in accordance with the law concerning free provision of land lots” - argued in the Ministry of Property Relations of the Republic of Buryatia.

In the Supreme Court of Buryatia were filed 2 complaints from citizens concerning the contestation of the republican law requirements. According to residents of Ulan-Ude city the residence requirement interferes in the implementation of their rights to receive land lot and registration of title in residential house. 

In total as of April 1, 2016 in Buryatia there are over 4500 illegal unauthorized buildings. 2402 buildings erected before 1990, 1069 buildings in the period from 2001 to 2010, 289 building were built after 2010. With the latest amendments to the Republican law, prepared by the Ministry of Property Relations of the Republic of Buryatia and introduced to the People’s Khural of the Republic of Buryatia by the Head of the Republic, self-willed houses became fewer nearly on 1.3 thousand.
